The Regulation on "Environmental Impact Assessment"

The newly enacted regulation on the controversial Environmental Impact Assessment sets brings several new standards and rules for the highly debated environmental aspects of investment projects in Turkey.


The newly enacted Regulation on Environmental Impact Assessment ("EIA") sets out the administrative and technical principles and rules applicable to the Environmental Impact Assessment rules in accordance with the Environment Law No.2872.
The revised regulation is crucial to the real estate, energy and manufacturing related investments in Turkey.  While the categorical classification of EIA has not changed, the new regulation lessens to a great extent the requirements of EIA by giving the Ministry of Environment a greater power of discretion at the stage of evaluation of applications.  The revised durational requirements may also be expected to be of the essence to the decision making processes of entities seeking to invest in Turkey.
